1.1 The Edinburgh Holistic Shop is a partnership operating in Scotland - The United Kingdom.
1.2 The Edinburgh Holistic Shop can be reached for any questions regarding the following terms and conditions and matters connected to any orders, purchases or anything else relevant to this on the following e-mail address: Edinburghholisticshop@gmail.com
1.3 Hereinafter we will refer to you as "you" or the "customer". We may refer to our brand as "we", "us" or "our" throughout this document.
1.4 These terms and conditions govern the selling terms of all orders placed by customers on the domain holisticshop.online, from the moment you place an order until payment and delivery. By placing an order, you agree to be legally bound by these terms and conditions. Please ensure you have read and understood this document before proceeding to place an order.
2. YOUR STATUS
2.1 By placing an order on our site you warrant that:
1. You are legally capable of entering into a binding agreement
2. You are at least 16 years of age
3. You are a resident of the UK or Europe
4. The information you enter on our site is correct to the best of your knowledge
5. Acknowledge you are not entitled to any compensation in any way due to parcel delays or loss for any reason, bank charges or dissatisfaction of the product, sizing or experience with us
2.2 On site you will follow the below steps in completing your order:
1. Find a product(s) that you like on the The Edinburgh Holistic Shop site
2. Check our size guide to ensure your product will fit to your desire
3. Select the size you require and press "add to basket"
4. Once you have added all the items you would like to your basket, select our "checkout" option
5. You will be prompted to fill out your shipping and billing information (please check you have put the correct information in)
6. Review your order to make sure all items and details are correct before completing the order as we may not be able to amend or cancel your order once it has been submitted
7. Press "complete order"
8. You will then shortly receive an order confirmation via e-mail to the e-mail address you provided at the time of ordering
9. Once you have received this email please check again all items and details are correct, contact us as soon as possible if anything has been entered incorrectly or you would like to cancel your order, failure to do so could mean we are unable to amend or cancel your order.
2.3 An "order confirmation" email does not mean your order has been accepted. It only means we have received your request to purchase our product(s). All orders are subject to availability, acceptance of us, information checks and your payment being received. We will confirm acceptance of your order to you by sending you an email that confirms your order has been dispatched (the "dispatch email").
2.4 In the unlikely event we are unable to fulfil your order for whatever reason, an email will be sent to the address supplied by yourself when you placed the order explaining the issue(s) and all possible solutions.
2.5 The Edinburgh Holistic Shop reserves the right to reject or cancel your order fulfilment of all orders place on the The Edinburgh Holistic Shop ltd site for any reason, including but not limited to the following:
1. The product is not available / in stock
2. Your billing information is not correct or not verifiable
3. Your order has been suspected of fraudulent activity
4. We could not deliver to the address provided by yourself
5. Force Majeure
6. In the event of misspelling, pricing or other errors
3. PRICING AND PAYMENT
3.1 The product prices displayed on the website are inclusive on Value-Added Tax (VAT) when applicable and do not include delivery charges. Delivery charges are shown separately when ordering and must also be paid in advance.
3.2 The Edinburgh Holistic Shop ltd has the right to change or update any prices or information and descriptions at any time on our site without prior warning. Any orders placed prior to the change of price cannot be amended to the revised price.
3.3 We try our hardest to ensure pricing is always correct on our site, however, sometimes there may be a mistake. In the event that you have placed an order during the period of incorrect pricing, the following will happen:
1. If you place an order at the time of a mistaken price greater then the correct value of the product, we will reject the order.
2. If you place an order at the time of a mistaken price greater then the correct value and the order has been processed, you will be refunded the difference. 3. If you place an order at the time of a mistaken lower value of the product, we will reject the order.
4. If you place an order at the time of a mistaken lower value of the product and the order has been processed, you will only be charged the price that was stated at the time of purchase, we will not charge or request to charge you the additional amount. In any of the above events happening, we will send you an email to the email you provided at the time of your purchase to inform you.
3.4 We do not accept cash, cheques or after pay. Payments for all products must be by credit card or debit card, we accept payment with Visa, Visa Debit, Mastercard, Solo, Maestro, Electron and Laser Card. We also accept payments via Paypal.
3.5 All payments are subject to validation checks and authorization by the payment service provider you have chosen. If the provider refuses to, or does not for any reason, authorize payment, you will then be notified by email and/or during checkout. When placing an order you must have full permission or authority to use the payment method and there must be sufficient funds to cover the costs of the goods and services. Payment shall not be deemed to be made, and therefore the order will not be dispatched, until we have received cleared funds in respect to the full amount stated in the order.
4. SHIPPING AND DELIVERY
4.1 Currently we only offer shipping within the UK and Europe and all orders are dispatched from the UK. We aim to get orders out within 3-5 working days and currently do not offer next day delivery, however if you need an order to arrive quicker please contact us prior to placing your order and we will do our best to make it possible although we cannot guarantee. Tracking numbers, if applicable, are included in your shipping confirmation email.
4.2 The amount of delivery fee will depend on your location and the items that you purchase. European orders and/or orders with large or heavy items will incur additional delivery fees. You will be able to find all delivery methods available during the checkout process. Prices can be changed at any time without further notice, you will only be charged the amount selected at the time of your order.
4.3 Your order will be dispatched with our standard delivery service.
4.4 The Edinburgh Holistic Shop cannot be held accountable for parcel delays or loss for any reason beyond our control.
4.5 Our carriers do not deliver on Sundays and public holidays.
5. RIGHT OF RETURNS, EXCHANGE AND REFUNDS
Exchange and Returns Policy of The Edinburgh Holistic Shop
We do everything to make you have a pleasant experience from start to finish on our website, but we know that sometimes things may go wrong or you may not have liked the product when you received it, so we have implemented an exchange and return policy based on the Consumer Protection Code, after all we want you to always come back and always be happy with our services.
Requests involving any type of exchange or return must be communicated as soon as possible via e-mail: Edinburghholisticshop@gmail.com reporting the reason for returning it and attaching photos of the product (s) in question when possible.
The request must be communicated within 14 (fourteen) calendar days from the date of receipt. After this period, it is not possible to accept exchanges or returns.
To exchange or return your product please read the following notes:
5.1- Exchange or return for withdrawal or regret:
When returning or exchanging products for regret, the following conditions must be observed:
The deadline for withdrawing the product is up to 14 (fourteen) consecutive days, counting from the date of receipt;
The product must be sent in the original or similar packaging, without damage or signs of use, without violation of the seal, accompanied by the invoice, manuals and accessories when there is one;
All products will be analysed. They will be sent back to the customer whenever damage or signs of use are found, or if one of the conditions described in the above topics has been breached, and all expenses will be borne by the customer;
As soon as the product is posted for return or exchange, it is necessary to send us the tracking code so that we can follow the progress too;
The customer can choose a credit to use in-person only in our shop or refund the full value of the returned product;
The refund or return of the exchange will be made within 14 (fourteen) days after receiving the product.
5.2 - Exchange or return due to manufacturing or craft defect:
When returning or exchanging products for manufacturing or craft defects, the following conditions must be observed:
The product must be sent in the original or similar packaging, accompanied by the invoice.
All products will be analysed. They will be sent back to the customer whenever no defect is found, there is evidence of misuse, or if one of the conditions described in the above topics has been breached, and all expenses will be borne by the customer;
If the technical report finds the manufacturing defect claimed, we will provide the exchange and reshipment within 14 days after receipt at our facilities, without incurring additional costs to the customer;
The Edinburgh Holistic Shop is exempt from the exchange or repair of products that suffer damage due to misuse or if the customer has not followed the guidelines in the assembly instructions provided with the product.
5. 3 - Return by registration of incorrect or incomplete delivery address:
It is essential that the registered delivery address is completely correct, without divergences or typing errors for the delivery to be carried out successfully. However, if the customer reports any wrong data that makes delivery impossible, the product will return to us and we will contact you. In this case, the cost of resending the order is borne by the buyer, so please make sure to fill in your registration details correctly.

5.4 In the event that you have been sent an incorrect item(s) from your order receipt, we will in that case accept a return of the item, provided it is in original condition, with no marks, damage, pulls or rips with all tags and still attached. We will either refund you for the item(s) or send you the correct item, free of delivery charges. We will send an email to you to the e-mail address you provided to discuss the options we have available at the time, subject to availability.
5.5 Once the item(s) has arrived back to us, we will process your refund or send your correct item within 48 hours. Please allow 3-5 working days for your funds to arrive back into your account or for your new parcel to arrive.
5.6 Refunds may only be made to the same payment method used to place the order.
5.7 If you choose to keep the incorrect item(s) with no refund or replacement, please still contact us to inform us what happened.
6.1 When a Gift Voucher for The Edinburgh Holistic Shop has been issued, the gift voucher becomes the property of that customer. Gift vouchers cannot be refunded, used to purchase another gift voucher or exchanged for money.
6.2 Only one discount code or promotion can be used per order. The Edinburgh Holistic Shop has the right to add or remove a discount code or promotion prior to use at any time without any prior warning. Discount codes can not be exchanged for cash equivalent. To claim you discount, simply enter your code when in "basket" section to the option "apply coupon", which will allow you to enter the promotion code to your order
6.3 Discount codes and promotions cannot be used on sale items
7.1 We take all complaints seriously and always welcome constructive criticism so we can grow as a business. We will always do our best to resolve disputes so soon as they arise, therefore please contact us as soon as possible on firstname.lastname@example.org .
9. PROPERTY INTELLECTUAL RIGHTS
9.1 The Edinburgh Holistic Shop ltd owns all intellectual property rights to the website and to the materials published on it, including, but not limited to, its HTML code, script, text, artwork, photographs, images, videos and audio (collectively "materials"). These works are protected by copyright laws worldwide.
9.2 Permission is granted to temporarily download one copy of the materials on The Edinburgh Holistic Shop website for personal, non-commercial use only. This is the grant of license, not a transfer of title and under the license you may not: modify or copy the materials, in any manner; use the materials for any commercial purpose; for any public display (commercial or non-commercial); remove any copyright or other proprietary notation from the materials. Any other unauthorized copying, alterations, distribution, transmission, display or other use of these materials is prohibited.
9.3 This license shall automatically terminate if you violate any of these restrictions and may be terminated by The Edinburgh Holistic Shop ltd at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed form.
10. PROHIBITED USE OF WEBSITE AND MATERIALS
10.1 You shall not post, transmit, redistribute, upload, or promote any communications, content or materials that contain corrupted files, viruses, or any other similar software files, the intent of which is to damage the operation of another's computer; are unlawful, threatening, harassing, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, sexually explicit, hateful, profane, indecent, racially or ethnically derogatory, or otherwise objectionable; contain chain letters or pyramid schemes; contain any unsolicited advertising, promotional materials, or other forms of solicitation to other users, individuals or entities; impersonate any person, business or entity, including us (our brands, lines of business, subsidiaries, and affiliated companies) and our employees and agents; encourage conduct that would constitute a criminal offense; give rise to civil liability; violate any law; or exhibit any conduct that, in our judgment, restricts, impairs, interferes or inhibits any other user from using or enjoying the Site and/or our related services and products. The Edinburgh Holistic Shop reserves the right to block or deny access to the website to anyone at any time for any reason.
11. WRITTEN COMMUNICATION
11.1 When using our website you agree that communication between us will be through email, postal or by posting notices and information on our website. You acknowledge that all contacts, notice, information or other communications that we provide to you will not affect your statutory rights.
12.1 If the product we deliver is not what you ordered or is damaged or defective or delivery is incorrect, on our part only, our only obligation will be as follows:
1. Make good of any shortages due to our error
2. Replace or repair any products that are damaged or defective
3. Refund you the amount paid by you for the product in question. We reserve this right to request evidence, such as images of the defect, before issuing any refund of the price and/or any associated delivery charges.
12.2 We will only comply with the above statement within 7 days of your order being dispatched. After such time we are no longer liable to comply with such obligations. Therefore we encourage you to contact us as soon as possible.
12.3 Our total liability to you shall not exceed the amount paid by you for the product.
12.4 We are not liable to cover the costs, refund or replace any orders or items due to third party faults, for example, loss of parcel due to the carrier used or due to any events out of our control. However we will reasonably endeavour to help resolve any disputes between yourself with third parties used by us in relation to your order or find a solution for you to the event out of our control in question.
12.5 A person who is not party to the agreement of these terms and conditions has no right to enforce any of these terms and conditions.
13. EVENTS OUT OF OUR CONTROL
13.1 We are not liable or responsible for any failure to perform, or delay in performance, or any obligations on the bases of these terms and conditions that is caused by events out of our reasonable control, (Force Majeure Event).
13.2 Our performance and obligations are to be deemed suspended for the period that the Force Majeure Event continues and we will be granted an extension of time for performance and obligations stated in these terms and conditions for the duration of that period. We will do our reasonable endeavours, where possible, to find a solution during this period despite a Force Majeure Event.
14.1 If we fail to insist upon strict compliance of these terms and conditions this will not relieve you from adhering to such obligations and does not cancel out any other obligation to follow the agreement of the points made out through these terms and conditions. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and if communicated to you in the manner stated in clause 13.
15.1 We have the right to terminate, change, suspend, modify, remove or discontinue any aspect of this website, policies or these terms and conditions at any time for any reason and without notice.
15.2 You will be subject to the policies and terms and conditions in force and agreed upon at the time that you ordered products from us, unless for any of the following reasons; any change to the website, policies or these terms and conditions is required to be made by law or government authority, in which case it will apply to orders previously placed by you; or if we notify you of the change(s) to policies and these terms and conditions before we send you the dispatch confirmation, if you do not confirm acceptance or notify us to the contrary of these changes within 48 hours we have the right to assume that you have accepted the change.
15.3 We also reserve the right to terminate authorization to the use of our materials or website, rights and licenses given on this website governed by these terms and conditions at any time and without notice. This termination of authorization, rights and licenses can be applied to all previously agreed terms and conditions and all future agreed terms and conditions.
